The DOF issued Circular No. 003-2024, directing the transfer of PHP 89.9 billion to the National Treasury, representing the fund balance or excess reserve funds of the PhilHealth. In compliance, the PhilHealth remitted PHP 60 billion to the National Treasury in three tranches. The SC issued a temporary restraining order (TRO) against the transfer of the remaining PHP 29.9 billion PhilHealth funds and the further implementation of Special Provision 1(d) of the 2024 GAA and DOF Circular No. 003-2024.

The Issue: Complainants allege that House leadership illegally inserted approximately ₱241 billion into the 2025 national budget by filling in "blank items" after the bicameral report had already been ratified. Verification/Status: The severity of these unauthorized allocations has resulted in two distinct, high-level legal challenges: Office of the Ombudsman (Criminal Complaints): In February 2025, figures including former Speaker Pantaleon Alvarez filed complaints for graft and falsification of public documents against Romualdez and other House leaders. This legal track seeks to establish direct criminal liability for physically altering the ratified report. The Ombudsman is actively evaluating these charges, which the House leadership has publicly dismissed as politically motivated diversionary tactics. Supreme Court (Constitutional Petitions): Concurrently, petitions were filed by former Executive Secretary Vic Rodriguez, Rep. Isidro Ungab, and others seeking to declare the 2025 General Appropriations Act (GAA) unconstitutional due to these exact insertions. Underscoring the gravity of the allegations, the Supreme Court intervened and mandated oral arguments. This required House Appropriations officials, specifically Rep. Stella Quimbo, to formally defend the legality of the budget and provide a constitutional justification for how the disputed "blanks" were filled.
